§1 Scope of Application

The following general terms and conditions apply exclusively to business relationships between Gute Marken Online GmbH and consumers.

§2 Contractual partners, conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. You can initially place our products in your shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. By clicking on the ‘Buy now’ button, you are placing a binding order for the goods contained in the shopping basket. You will then receive an automated email as order confirmation. With this email, the contract has been concluded. A binding contract may also be concluded in advance as follows:

If you have chosen PayPal as your payment method, the contract is concluded at the time of your confirmation of the payment order to PayPal.

The language available for the conclusion of the contract is German.

We will store the contract text and send you the order details and our terms and conditions by email. You can also view the terms and conditions at any time on this page. For security reasons, your past orders are no longer accessible via the Internet.

§3 Prices and shipping costs

The prices listed on the product pages in the online shop include statutory value added tax and other price components.

For deliveries within Germany with a minimum order value of €19.95, shipping costs of €0.99 apply, regardless of the size or weight of your order. The shipping costs for deliveries to other countries with a minimum order value of €49.90 are €5.95 or €7.95 (depending on the country), regardless of the size or weight of your order. This only partially covers the costs incurred for postage, freight and packaging.

The shipping costs are clearly stated on the product pages, in the shopping cart system and again on the order page.

§4 Payment

During the ordering process, we accept payment by credit card (Visa/Mastercard), PayPal, Amazon Pay and purchase on account (subject to creditworthiness).

Credit card

We accept VISA and Mastercard credit cards. If you would like to pay by credit card, please enter your name, credit card number, 3-digit security code and expiry date when placing your order. The 3-digit security code can be found in the signature field on the back of the credit card. As we do not store credit card details, you will need to re-enter your credit card details for each order. Once you have been verified as the legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged immediately after the goods have been dispatched.

PayPal

If you would like to pay via PayPal, select the corresponding payment method during the ordering process. You will be automatically redirected to PayPal. Log in to PayPal with your email address and password and follow the instructions. Your goods will be shipped as soon as the full invoice amount has been credited to our account.

Payment via Amazon Pay

Payment via Amazon allows you to use your customer data stored with Amazon.de for your online purchases in our shop. Your bank account or credit card will only be charged once your order has been delivered to your address.

Paying via Amazon allows you to use your customer data stored on Amazon.de for your online purchases in our shop. Your bank account or credit card will only be charged once the delivery of your order to your delivery address has been confirmed. Amazon Pay does not pass on the payment details stored in your Amazon.de customer account to us, and you do not need to enter them when placing your order.

Purchase on account

When purchasing on account, the billing and delivery addresses must be identical and located within Germany. The invoice amount is due upon receipt of the invoice. Please indicate the order number in the reference field when paying the invoice amount. When paying on account, Gute Marken Online GmbH checks and evaluates the data provided by the customer. If there is justified cause, Gute Marken Online GmbH will exchange data with credit agencies such as Creditreform Rosenheim Karl KG, Oberaustraße 14, 83026 Rosenheim.

Klarna

Invoice payments are handled entirely by Klarna. Unfortunately, we have no influence over the approval or rejection of invoice purchases. If you have any questions regarding this, please contact Klarna directly:

You have the possibility to choose between the following payment methods:

  • KLARNA Invoice Purchase: Payment to Klarna is only required after receiving the goods. The invoice will be sent to you directly by Klarna via email. From the invoice date, you have 14 days to complete the payment.
  • KLARNA Financing: With Klarna’s financing service, you have the option to pay for your purchase flexibly in monthly instalments of at least 1/24 of the total amount (but at least €6.95) or under the other conditions specified at checkout.
  • KLARNA Pay in full: Pay for your purchase immediately after completing your order using your usual online banking details.
  • KLARNA Direct Debit: Select the „Pay now" option at checkout. Then choose „Direct Debit" as your payment method. Finally, select your bank, log in – and that’s it. The amount will be automatically deducted from your account a few days later.
  • KLARNA pay now: Here no restriction is necessary for you. You can select „Klarna – Pay now" at the checkout and must then fill out your bank details. The money will then be transferred directly.

KLARNA pay later: The payment to Klarna is made after receipt of the goods. The invoice will then be sent to you by Klarna directly by e-mail. From the invoice date you have 14 days to pay it.

§5 Delivery

Unless otherwise agreed, delivery shall be made from the logistics centre of Gute Marken Online GmbH to the delivery address specified by the buyer. Delivery within Germany shall be made by DHL.

§6 Redeeming vouchers (voucher codes)

First, add your desired items to the shopping cart. The input field for vouchers/voucher codes can be found in the last step of the ordering process in the shopping cart above the payment overview in the shopping cart. Please enter the voucher code here and confirm by clicking on the ‘REDEEM NOW’ button. The voucher amount will then be immediately deducted from the total amount in the shopping cart.

The following general voucher conditions apply:

  • Only one voucher can be redeemed per order.
  • Multiple vouchers, especially vouchers from different voucher promotions, cannot be combined.
  • Vouchers can only be redeemed during the ordering process. Unfortunately, it is not possible to issue a credit note retrospectively.
  • Vouchers cannot be exchanged for cash.
  • The resale of vouchers is not permitted.

The following additional conditions apply to promotional vouchers/promotional voucher codes and all vouchers/voucher codes with a minimum purchase value:

  • Promotional vouchers have a minimum purchase value, which is always stated on the voucher or together with the voucher code. Minimum purchase value (‘from a purchase of …’) means that a binding purchase contract must be concluded and executed above this amount, even after you have exercised your right of withdrawal.
  • If the purchase value of your order falls below the respective minimum purchase value due to the exercise of a right of withdrawal/return, it is not possible to redeem this voucher/voucher code for this purchase.
  • If the minimum purchase value of a voucher/voucher code with a lower minimum purchase value from the same voucher promotion is reached, this voucher will automatically be credited to your purchase. If the minimum purchase value of the smallest voucher in the corresponding voucher promotion is not reached, the total of the individual prices of the purchased items must be paid without deduction.
  • Promotional vouchers and voucher promotions have a limited period of validity, which is also stated on the voucher or together with the voucher code. After the end of the promotional period, the voucher code can no longer be used. An extension is not possible.

The following additional conditions apply to gift vouchers and other vouchers without a minimum purchase value:

  • If you exercise your right of withdrawal for a purchase in which a gift voucher (code) or other voucher (code) without a minimum purchase value has been redeemed, you will receive a new voucher (code) in addition to a possible refund of any additional payments made for unused voucher amounts or partial voucher amounts. The same conditions apply to the new voucher (code) as to the original voucher (code).
  • Gift vouchers/gift voucher codes and other vouchers/voucher codes without a minimum purchase value have a limited period of validity, which is also stated on the voucher or together with the voucher code. After the end of the validity period, the voucher (code) can no longer be used. An extension is not possible.

§7 Conditions for promotional gifts/bonuses

First, add your desired items to the shopping cart. During the term of a bonus promotion, the bonus item will automatically appear in the shopping cart once the minimum purchase value has been reached.

The following general conditions apply to promotional gifts/bonuses:

  • You can only receive one gift/bonus per order.
  • The offer of a promotional gift/bonus cannot be combined with voucher promotions.
  • Gifts cannot be exchanged for a refund of the regular purchase price of the bonus item.
  • Promotions with promotional gifts have a minimum purchase value, which is always specified with the promotional gift offer.
  • Minimum purchase value (‘from a purchase of …’) means that a binding purchase contract must be concluded and executed above this amount, even after you have exercised your right of withdrawal. If the purchase value of your order falls below the respective minimum purchase value due to the exercise of a right of withdrawal/return, the gift/bonus item cannot be granted for this purchase. In such cases, the gift/bonus item must therefore be returned with the goods. In this respect, the provisions of the cancellation policy apply.
  • Bonus promotions have a limited period of validity, which is also specified in the advertisement for the bonus promotion. The period of validity is often limited to one promotion day. The bonus cannot be granted for purchases made outside the promotion period. An extension is not possible.

§8 Cancellation policy

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. To exercise your right of withdrawal, you must inform us (Gute Marken Online GmbH c/o Alt FineCom Logistics GmbH, Wulfshofstraße 18-22, 44149 Dortmund, service@men.pierre-cardin.eu, Tel: +49 (0) 89 412 07559) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of revocation

If you revoke this contract, we shall reimburse you for all payments we have received from you, less any return costs of €3.95, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within 14 days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us, Gute Marken Online GmbH c/o Alt FineCom Logistics GmbH Wulfshofstraße 18-22 44149 Dortmund, immediately and in any case no later than 14 days from the date on which you notify us of the cancellation of this contract.

The deadline is met if you send the goods before the 14-day period expires. We will bear the costs of returning the goods. You will only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties and functionality.

§9 Newsletter – Electronic advertising

  1. Scope of application

The following terms and conditions apply to subscriptions to newsletters from Gute Marken Online GmbH.

  1. Consent

Consent is given during the registration process for the Gute Marken Online GmbH newsletter via the double opt-in procedure. After submitting the corresponding registration form, an automated email is sent to the specified recipient address. In this email, the recipient is asked to confirm their newsletter subscription by clicking on a link. Only after this confirmation is the entry in the newsletter distribution list activated and the recipient will receive the desired newsletter in future. By registering for the newsletter and clicking on the confirmation link, the subscriber gives their express consent to the regular sending of the subscribed newsletter.

  1. Distribution

The newsletter is sent to customers and interested parties at regular intervals of approximately one week. The customer has no right to receive a newsletter.

  1. Right of withdrawal regarding the newsletter

The newsletter subscriber can revoke their consent at any time by post (Gute Marken Online GmbH, Christoph-Rapparini-Bogen 25 (3rd floor) 80639 Munich) or by email (service@men.pierre-cardin.eu) or unsubscribe from the newsletter at men.pierre-cardin.eu/newsletter and via a link in each newsletter. In the event of revocation, Gute Marken Online GmbH will no longer send newsletters to the email address provided by the customer in future. Only the costs according to the basic rates (e.g. postage or mobile phone charges) are incurred.

  1. Data protection

Unless the subscriber gives additional consent to the further processing and use of the information provided when subscribing to the newsletter, including personal data, this information will be stored, processed and used electronically in machine-readable form by GUTE MARKEN ONLINE GmbH exclusively for the purpose of sending the newsletter. Gute Marken Online GmbH will only store the data for as long as is necessary and permitted by law. Gute Marken Online GmbH does not pass on the data to other companies unless this is necessary for the sending of the newsletter itself (e.g. through the involvement of a service provider, advertising agency, etc.). The transfer of data to the ‘pierre cardin’ brand can be agreed to during the registration process. The newsletter subscriber can revoke this consent at any time.

  1. Liability

Gute Marken Online GmbH is not liable for incorrect information caused and disseminated by subscribers and/or third parties in connection with the sending of information via the newsletter. In particular, Gute Marken Online GmbH accepts no liability if emails or data entries (e.g. in online subscriber forms for the newsletter) do not meet the technical requirements specified in these General Terms and Conditions or those specified for the website and are therefore not accepted and/or acknowledged by the system.

§10 Transport damage

If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately. Failure to file a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance company.

§11 Warranty

The warranty for defects in the purchased goods is governed by the statutory provisions. In particular, the customer may demand subsequent performance (new delivery or rectification of defects). However, Gute Marken Online GmbH is entitled to refer the customer to a new delivery if the rectification of defects would involve disproportionate effort. Warranty claims expire two years after delivery of the goods. The buyer should assert their warranty claims by stating the order number, their name and address, and a brief description of the reasons.

At the request of Gute Marken Online GmbH, the customer shall send the defective goods for inspection at the expense and risk of Gute Marken Online GmbH to the following address:

§12 Liability

Gute Marken Online GmbH shall be liable without limitation for intent. Gute Marken Online GmbH shall only be liable for gross and simple negligence in the event of injury to life, limb, health, or a material contractual obligation. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract and on whose fulfillment the customer has relied and was entitled to rely.

In the event of a slightly negligent breach of essential contractual obligations, the seller’s liability is limited to the foreseeable, typically occurring damage.

The above limitations of liability also apply in favor of the seller’s legal representatives and vicarious agents.

Liability under the Product Liability Act remains unaffected.

§13 Retention of title

Die gelieferte Ware bleibt bis zur vollständigen Bezahlung im Eigentum der Firma Gute Marken Online GmbH.

§14 Consumer arbitration, information pursuant to Section 36 VSBG

The seller is neither obliged by specific regulations to participate in dispute resolution proceedings before this consumer arbitration board, nor does he voluntarily agree to do so.

§15 Final provisions

All contracts between Gute Marken Online GmbH and the customer are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

In such cases, the gift/bonus item must therefore be returned with the goods. In this respect, the provisions of the cancellation policy apply.

Consequences of revocation

If you revoke this contract, we shall reimburse you for all payments we have received from you, less any return costs of €3.95, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within 14 days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. §9 Newsletter – Electronic advertising

  1. Scope of application

The following terms and conditions apply to subscriptions to newsletters from Gute Marken Online GmbH.

  1. Consent

Consent is given during the registration process for the Gute Marken Online GmbH newsletter via the double opt-in procedure. After submitting the corresponding registration form, an automated email is sent to the specified recipient address. In this email, the recipient is asked to confirm their newsletter subscription by clicking on a link. Only after this confirmation is the entry in the newsletter distribution list activated and the recipient will receive the desired newsletter in future. In particular, Gute Marken Online GmbH accepts no liability if emails or data entries (e.g. in online subscriber forms for the newsletter) do not meet the technical requirements specified in these General Terms and Conditions or those specified for the website and are therefore not accepted and/or acknowledged by the system.

§10 Transport damage

If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us immediately. Failure to file a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance company.

§11 Warranty

The warranty for defects in the purchased goods is governed by the statutory provisions. In particular, the customer may demand subsequent performance (new delivery or rectification of defects). However, Gute Marken Online GmbH is entitled to refer the customer to a new delivery if the rectification of defects would involve disproportionate effort. Warranty claims expire two years after delivery of the goods. The buyer should assert their warranty claims by stating the order number, their name and address, and a brief description of the reasons.

§12 Liability

Gute Marken Online GmbH shall be liable without limitation for intent. Gute Marken Online GmbH shall only be liable for gross and simple negligence in the event of injury to life, limb, health, or a material contractual obligation. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract and on whose fulfillment the customer has relied and was entitled to rely.

In the event of a slightly negligent breach of essential contractual obligations, the seller’s liability is limited to the foreseeable, typically occurring damage.

The above limitations of liability also apply in favor of the seller’s legal representatives and vicarious agents.

Liability under the Product Liability Act remains unaffected.

§13 Retention of title

Die gelieferte Ware bleibt bis zur vollständigen Bezahlung im Eigentum der Firma Gute Marken Online GmbH.

§14 Consumer arbitration, information pursuant to Section 36 VSBG

The seller is neither obliged by specific regulations to participate in dispute resolution proceedings before this consumer arbitration board, nor does he voluntarily agree to do so.

§15 Final provisions

All contracts between Gute Marken Online GmbH and the customer are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
